BY ACCESSING OR USING THE MYSTAFF.MY WEBSITE, PLATFORM, OR ANY SERVICES PROVIDED BY US, YOU AGREE TO BE BOUND BY THESE TERMS OF SERVICE AND ALL TERMS INCORPORATED BY REFERENCE. IF YOU DO NOT AGREE TO ALL OF THESE TERMS, DO NOT ACCESS OR USE OUR SERVICES.

1. Introduction and Agreement to Terms

These Terms of Service (“Terms”) govern your access to and use of the MyStaff.my website, platform, applications, and related services (collectively, the “Services”) operated by Aftergroup EOOD (“MyStaff,” “we,” “us,” or “our”). These Terms constitute a legally binding agreement between you (either an individual or an entity you represent, “you” or “User”) and Aftergroup EOOD.

By registering for an account, accessing, or using any part of our Services, you acknowledge that you have read, understood, and agree to be bound by these Terms, our Privacy Policy (available at https://mystaff.my/privacy-policy), and any other policies or guidelines posted on our Services, which are incorporated herein by reference.

If you are using the Services on behalf of an organization or entity (“Organization”), then you are agreeing to these Terms on behalf of that Organization, and you represent and warrant that you have the authority to bind the Organization to these Terms. In that case, “you” and “your” will refer to that Organization.

3. Eligibility and Account Responsibilities

  • 3.1. Eligibility: To use our Services, you must be at least 18 years old and capable of forming a binding contract with Aftergroup EOOD. If you are under 18, you may not use the Services. By using the Services, you represent and warrant that you meet these eligibility requirements.

  • 3.2. Account Creation: To access certain features of the Services (e.g., as an employer or recruiter), you may be required to register for an account. You agree to:

    • Provide accurate, current, and complete information during the registration process.

    • Maintain and promptly update your account information to keep it accurate, current, and complete.

    • Maintain the security and confidentiality of your account credentials (username and password). Do not share your credentials with any third party.

    • Notify us immediately at support@mystaff.my if you suspect any unauthorized use of your account or any other breach of security.

  • 3.3. Account Responsibility: You are solely responsible for all activities that occur under your account, whether or not you have authorized such activities. We are not liable for any loss or damage arising from your failure to comply with these requirements.

  • 3.4. Account Types: We may offer different types of accounts (e.g., for employers, recruiters, candidates). Your access to and use of the Services may vary depending on your account type.

4. Service Usage and Acceptable Use Policy

  • 4.1. Service Description: MyStaff.my provides an online platform and tools designed to facilitate the hiring process, including but not limited to creating custom job application forms, posting job opportunities, managing candidate applications, and scheduling interviews.

  • 4.2. License to Use Services: Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to access and use the Services for your internal business purposes (if you are an employer/recruiter) or for your personal, non-commercial job-seeking purposes (if you are a candidate).

  • 4.3. Acceptable Use: You agree to use the Services in compliance with all applicable local, national, and international laws and regulations. You further agree not to, and not to permit others to:

    • Use the Services for any unlawful, fraudulent, misleading, malicious, or discriminatory purpose.

    • Post job listings that are inaccurate, false, misleading, fraudulent, or that violate any applicable laws (including employment, equal opportunity, and anti-discrimination laws).

    • Post content that is defamatory, obscene, pornographic, vulgar, offensive, or that promotes illegal or harmful activities or substances.

    • Infringe upon or violate the intellectual property rights or any other rights of others, including privacy and publicity rights.

    • Harass, abuse, insult, harm, defame, slander, disparage, intimidate, or discriminate based on gender, sexual orientation, religion, ethnicity, race, age, national origin, or disability.

    • Transmit any worms, viruses, trojans, or any code of a destructive or malicious nature.

    • Attempt to gain unauthorized access to, interfere with, damage, or disrupt any parts of the Services, the server on which the Services are stored, or any server, computer, or database connected to the Services.

    • Reverse engineer, decompile, disassemble, or otherwise attempt to discover the source code or underlying ideas or algorithms of the Services.

    • Use any robot, spider, scraper, or other automated means to access the Services for any purpose without our express written permission.

    • Collect or track the personal information of others without their explicit consent or for purposes unrelated to the intended use of the platform.

    • Impersonate any person or entity, or falsely state or otherwise misrepresent your affiliation with a person or entity.

    • Use the Services to send unsolicited commercial communications (spam).

    • Interfere with or circumvent the security features of the Services.

5. Intellectual Property Rights

  • 5.1. Our Intellectual Property: All rights, title, and interest in and to the Services, including but not limited to all content (excluding User Content as defined below), text, graphics, logos, icons, images, audio clips, video clips, data compilations, software, technology, and the design, selection, and arrangement thereof, are and will remain the exclusive property of Aftergroup EOOD and its licensors. The Services are protected by copyright, trademark, and other laws of Bulgaria and foreign countries. You may not copy, reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any of the material on our Services, except as follows:

    • Your computer may temporarily store copies of such materials in RAM incidental to your accessing and viewing those materials.

    • You may store files that are automatically cached by your Web browser for display enhancement purposes.

    • You may print or download one copy of a reasonable number of pages of the website for your own permitted use and not for further reproduction, publication, or distribution. Any use of the Services not expressly permitted by these Terms is a breach of these Terms and may violate copyright, trademark, and other laws.

  • 5.2. Trademarks: The MyStaff.my name, the Aftergroup name, our logos, and all related names, logos, product and service names, designs, and slogans are trademarks of Aftergroup EOOD or its affiliates or licensors. You must not use such marks without the prior written permission of Aftergroup EOOD. All other names, logos, product and service names, designs, and slogans on the Services are the trademarks of their respective owners.

6. User Content

  • 6.1. Definition: “User Content” means any and all information and content that a User submits to, or uses with, the Services (e.g., content in job forms, job descriptions, candidate data including CVs and cover letters, messages, reviews, feedback).

  • 6.2. Ownership: You retain all your ownership rights in your User Content. We do not claim ownership over your User Content.

  • 6.3. License to User Content: By submitting, posting, or displaying User Content on or through the Services, you grant MyStaff (and our successors and affiliates) a non-exclusive, worldwide, royalty-free, fully paid-up, transferable, sublicensable (through multiple tiers) license to use, host, store, reproduce, modify (for formatting purposes), process, adapt, publish, transmit, display, and distribute such User Content solely for the purposes of operating, providing, improving, and promoting the Services and as otherwise permitted by our Privacy Policy.

  • 6.4. Responsibility for User Content: You are solely responsible for your User Content. You assume all risks associated with the use of your User Content, including any reliance on its accuracy, completeness, or usefulness by others, or any disclosure of your User Content that personally identifies you or any third party. You represent and warrant that your User Content does not violate our Acceptable Use Policy (Section 4.3). We are not obligated to backup any User Content, and your User Content may be deleted at any time without prior notice. You are solely responsible for creating and maintaining your own backup copies of your User Content if you desire.

  • 6.5. Candidate Data: Employers and recruiters acknowledge that candidate data (CVs, applications, etc.) submitted through the platform is confidential information belonging to the candidates. You agree to handle such data in compliance with all applicable data protection laws (including GDPR) and our Privacy Policy, and solely for legitimate recruitment purposes.

  • 6.6. Feedback: If you provide us with any feedback or suggestions regarding the Services (“Feedback”), you hereby assign to Aftergroup EOOD all rights in such Feedback and agree that Aftergroup EOOD shall have the right to use and fully exploit such Feedback and related information in any manner it deems appropriate. We will treat any Feedback you provide to us as non-confidential and non-proprietary.

7. Fees and Payment (If Applicable)

  • 7.1. Service Fees: Certain features of the Services may be subject to fees (“Paid Services”). If you choose to use Paid Services, you agree to pay all applicable fees as described on our website or as otherwise communicated to you. All fees are non-refundable except as expressly stated in these Terms or as required by law.

  • 7.2. Payment Terms: We may use a third-party payment processor to bill you through a payment account linked to your account. The processing of payments will be subject to the terms, conditions, and privacy policies of the payment processor in addition to these Terms.

  • 7.3. Subscription Services: If you subscribe to a Paid Service, your subscription may automatically renew for successive periods unless you cancel your subscription before the end of the current subscription period. You authorize us to charge your payment method for the renewal subscription fees.

  • 7.4. Taxes: All fees are exclusive of applicable taxes (e.g., VAT), which you are responsible for paying, if any.

  • 7.5. Changes to Fees: We reserve the right to change our fees or introduce new charges at any time, upon notice to you, which may be sent by email or posted on the Services. Your continued use of the Paid Services after such notification constitutes your agreement to the new fees.

8. Termination

  • 8.1. Termination by You: You may terminate your account and these Terms at any time by contacting support@mystaff.my or through any account deletion feature provided within the Services. Termination will be effective upon our processing of your request.

  • 8.2. Termination by Us: We reserve the right, in our sole discretion, to suspend, restrict, or terminate your access to and use of the Services, or any portion thereof, at any time and for any reason, including but not limited to:

    • If you breach any provision of these Terms.

    • If we are required to do so by law.

    • If we believe that your use of the Services poses a security risk or could subject us or other users to liability.

    • If we decide to discontinue the Services or any part thereof. We will make reasonable efforts to notify you of such termination or suspension, where appropriate.

  • 8.3. Effect of Termination: Upon termination of these Terms or your account:

    • Your right to use the Services will immediately cease.

    • We may delete your account and all User Content associated with it, subject to our data retention policies and applicable law. We are not liable for any loss of User Content due to termination.

    • Any provisions of these Terms that by their nature should survive termination shall survive, including, without limitation, ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

9. Disclaimers

THE SERVICES ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS, WITHOUT ANY WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ANY WARRANTIES ARISING OUT OF COURSE OF DEALING OR USAGE OF TRADE.

AFTERGROUP EOOD AND ITS AFFILIATES, LICENSORS, AND SERVICE PROVIDERS DO NOT WARRANT THAT: (A) THE SERVICES WILL BE SECURE, ERROR-FREE, UNINTERRUPTED, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS; (B) THE RESULTS THAT MAY BE OBTAINED FROM THE USE OF THE SERVICES WILL BE ACCURATE, RELIABLE, OR COMPLETE; (C) ANY DEFECTS OR ERRORS WILL BE CORRECTED; OR (D) THE SERVICES WILL MEET YOUR REQUIREMENTS OR EXPECTATIONS.

WE MAKE NO REPRESENTATIONS OR WARRANTIES REGARDING THE TRUTHFULNESS, ACCURACY, LEGALITY, COMPLETENESS, TIMELINESS, OR RELIABILITY OF ANY JOB POSTINGS, CVS, CANDIDATE PROFILES, OR OTHER USER CONTENT SUBMITTED THROUGH THE SERVICES. YOU ACKNOWLEDGE THAT ANY RELIANCE ON SUCH MATERIAL OR CONTENT WILL BE AT YOUR OWN RISK.

MYSTAFF.MY IS A PLATFORM. WE ARE NOT INVOLVED IN THE ACTUAL TRANSACTIONS BETWEEN EMPLOYERS AND CANDIDATES. AS A RESULT, WE HAVE NO CONTROL OVER THE QUALITY, SAFETY, OR LEGALITY OF THE JOBS OR CVS POSTED, THE TRUTH OR ACCURACY OF THE LISTINGS, THE ABILITY OF EMPLOYERS TO OFFER JOB OPPORTUNITIES TO CANDIDATES, OR THE ABILITY OF CANDIDATES TO FILL JOB OPENINGS.

10. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL AFTERGROUP EOOD, ITS AFFILIATES, DIRECTORS, OFFICERS, EMPLOYEES, AGENTS, SUPPLIERS, OR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO, DAMAGES FOR LOSS OF PROFITS, REVENUE, GOODWILL, USE, DATA, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATING TO YOUR ACCESS TO OR USE OF, OR YOUR INABILITY TO ACCESS OR USE, THE SERVICES OR ANY CONTENT OR MATERIALS THEREON, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), STATUTE, OR ANY OTHER LEGAL THEORY, AND WHETHER OR NOT WE HAVE BEEN INFORMED OF THE POSSIBILITY OF SUCH DAMAGE.

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, OUR AGGREGATE LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THE USE OF OR ANY INABILITY TO USE ANY PORTION OF THE SERVICES OR OTHERWISE UNDER THESE TERMS, WHETHER IN CONTRACT, TORT, OR OTHERWISE, IS LIMITED TO THE GREATER OF: (A) THE AMOUNT YOU HAVE PAID TO US FOR ACCESS TO AND USE OF THE SERVICES IN THE TWELVE (12) MONTHS PRIOR TO THE EVENT GIVING RISE TO THE CLAIM, OR (B) ONE HUNDRED EUROS (EUR 100).

SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF CERTAIN DAMAGES, SO SOME OF THE ABOVE LIMITATIONS AND EXCLUSIONS MAY NOT APPLY TO YOU.

11. Indemnification

You agree to defend, indemnify, and hold harmless Aftergroup EOOD, its affiliates, licensors, and service providers, and its and their respective officers, directors, employees, contractors, agents, licensors, suppliers, successors, and assigns from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys’ fees) arising out of or relating to: (a) your violation of these Terms; (b) your User Content; (c) your use of the Services, including, but not limited to, any use of the Service’s content, services, and products other than as expressly authorized in these Terms; or (d) your violation of any applicable laws or regulations or the rights of any third party.

12. Governing Law and Dispute Resolution

  • 12.1. Governing Law: These Terms and any dispute or claim arising out of or in connection with them or their subject matter or formation (including non-contractual disputes or claims) shall be governed by and construed in accordance with the laws of Bulgaria, without regard to its conflict of law principles.

  • 12.2. Jurisdiction: You agree that any legal suit, action, or proceeding arising out of or related to these Terms or the Services shall be instituted exclusively in the competent courts of Sofia, Bulgaria. You waive any and all objections to the exercise of jurisdiction over you by such courts and to venue in such courts.

  • 12.3. Informal Dispute Resolution: We encourage you to contact us at support@mystaff.my if you have an issue, as we would like to try to resolve it informally. Before filing a claim against Aftergroup EOOD, you agree to try to resolve the dispute informally by contacting us. We’ll try to resolve the dispute informally by contacting you via email. If a dispute is not resolved within 30 days of submission, you or Aftergroup EOOD may bring a formal proceeding.

13. Changes to These Terms

We reserve the right, in our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will make reasonable efforts to provide at least 30 days’ notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.

Changes will be effective immediately upon posting the revised Terms on this page, and we will update the “Last Updated” date at the top of these Terms. Your continued access to or use of the Services after any such changes constitutes your acceptance of the new Terms. If you do not agree to the new terms, you must stop using the Services. We encourage you to review these Terms periodically for any changes.

Significant changes may also be communicated via email to the primary email address associated with your account or through a notice on our platform.

14. General Provisions

  • 14.1. Entire Agreement: These Terms, together with our Privacy Policy and any other legal notices or terms published by us on the Services, constitute the entire agreement between you and Aftergroup EOOD concerning the Services and supersede all prior and contemporaneous understandings, agreements, representations, and warranties, both written and oral, regarding the Services.

  • 14.2. Severability: If any provision of these Terms is held by a court or other tribunal of competent jurisdiction to be invalid, illegal, or unenforceable for any reason, such provision shall be eliminated or limited to the minimum extent such that the remaining provisions of the Terms will continue in full force and effect.

  • 14.3. Waiver: No waiver by Aftergroup EOOD of any term or condition set out in these Terms shall be deemed a further or continuing waiver of such term or condition or a waiver of any other term or condition, and any failure of Aftergroup EOOD to assert a right or provision under these Terms shall not constitute a waiver of such right or provision.

  • 14.4. Assignment: You may not assign or transfer these Terms, by operation of law or otherwise, without our prior written consent. Any attempt by you to assign or transfer these Terms, without such consent, will be null and void. We may assign or transfer these Terms, at our sole discretion, without restriction. Subject to the foregoing, these Terms will bind and inure to the benefit of the parties, their successors, and permitted assigns.

  • 14.5. Notices: Any notices or other communications provided by Aftergroup EOOD under these Terms, including those regarding modifications to these Terms, will be given: (i) via email; or (ii) by posting to the Services. For notices made by e-mail, the date of receipt will be deemed the date on which such notice is transmitted.

  • 14.6. Headings: The section titles in these Terms are for convenience only and have no legal or contractual effect.

  • 14.7. Force Majeure: We shall not be liable for any failure to perform our obligations hereunder where such failure results from any cause beyond our reasonable control, including, without limitation, mechanical, electronic, or communications failure or degradation.
